What the County is hiding from you

As you may be aware of, the Boulder County Commissioner have voted to impose a Subdivision Paving Local Improvement District (LID) in unincorporated Boulder County. Make no mistake about it, the Commissioners voted, for their interests and against yours

Although there are many unanswered questions about the LID, the County has stated that per state law they will record “the total amount of assessment” on your property no later than Monday December 2nd.  But according to the Boulder County Attorney and Treasurer’s offices “you will not receive a bill for the full amount” of the assessment.

What are they hiding?

Why is it important that you know the full amount of your full assessment?  Because unless you “pay the whole assessment within said period of thirty days”, e.g., by December 21, you “shall be conclusively held and considered as consenting to said improvements” and will give up your rights to “to question the power or jurisdiction of the county to construct the improvements, the quality of the work, the regularity or sufficiency of the proceedings, the validity or the correctness of the assessments, or the validity of the lien”.

 

In other words, by NOT telling you the entire amount that you owe up front, thus NOT giving you the chance to pay that FULL AMOUNT, you will GIVE UP your legal rights and the County will silence you on everything involving the LID for 15 years!  How’s that for government working on the behalf of the best interests of the people?

 

What BoCo FIRM is doing to protect your rights
Last week Boulder County FIRM’s attorney, Madeline Meacham of Halpern Meacham LLP, filed suit against the Boulder County Commissioners to stop Resolution 2013-106, the unfairness in road maintenance resolution.  We intend to seek a preliminary injunction to stop the County from imposing the LID in the coming days.  To read the complaint we have filed on your behalf or to keep informed by signing up to receive our updates go to www.BoCoFIRM.org.
